Four Nassar plaintiffs plan to add allegations against MSU

Update June 12, 12:15 p.m. — According to court records, an order was filed which granted the motion for leave on June 9. This allowed the plaintiffs in this case to file the second amended complaint June 12. 


Four plaintiffs in a lawsuit related to ex-MSU doctor Larry Nassar plan to file an amended complaint to add allegations against MSU defendants.

The plaintiffs filed a motion for leave on Tuesday. If this motion to leave the court is granted, the plaintiffs will amend their original complaint — adding allegations against MSU defendants listed in the case.

The lawsuit lists Nassar, MSU, the MSU Board of Trustees, USA Gymnastics and Twistars Gymnastics Club as defendants. The plaintiffs in this case are Jane AAA Doe, Jane BBB Doe, Jane CCC Doe and Jane DDD Doe.

The additional allegations relate to the MSU defendants' refusal to reopen plaintiff Jane AAA Doe's Title IX investigation and what they allege are additional fiduciary relationships and duties in regard to all defendants.

"The MSU Defendants' refusal to reopen Plaintiff Jane AAA Doe's Title IX investigation further confirms the MSU Defendants' have failed to take appropriate action and remain deliberately indifferent toward the sexual assault, battery, molestation, harassment, and discrimination of Plaintiff Jane AAA Doe," as it reads in the plaintiffs' amended complaint.

The amended complaint also alleges "special, confidential, and fiduciary" relationships were formed between plaintiffs and defendants MSU, USA Gymnastics and Twistars Gymnastics Club when plaintiffs sought treatment from Nassar. It alleges these defendants owed plaintiffs "a duty to disclose known acts of sexual assault, battery, molestation, and harassment against Plaintiffs."

The plaintiffs first filed their complaint March 20, 2017. The allegations they hope to add took place after the first complaint and/or were discovered by plaintiffs after the first complaint was filed.

Nassar is accused of sexually abusing patients and other young women with whom he came into contact. He was arrested in December 2016 on charges of possessing “at least 37,000” images of child pornography.
