"The Michigan State Police conducted the investigation into the incident and submitted its findings to the Ingham County Prosecutors Office for review regarding the use of force and the potential for criminal charges against the involved officers," the release reads. 

Referrals to the Michigan Attorney General’s Office are standard policy procedure in officer-involved shootings; however, the release identifies both a personal and professional relationship with the alleged stabbing victim, 63-year-old attorney Douglas Mielock.

In an email correspondence to The State News Tuesday evening, a representative of the Michigan Department of Attorney General said that the case was just received by their office today and that it "will be assigned for thorough review by an assistant attorney general."

"I am unable to speculate for you a timeline upon which this review may conclude — each review undertaken by our office is directed by the investigation and evidence," said Danny Wimmer, Attorney General press secretary. "Upon conclusion of our review, our office typically issues a press release announcing our decision as to whether prosecution is warranted and, in instances when no prosecution is commenced, an extensive report detailing the incident and our legal conclusions."

The fatal officer-involved shooting originally occurred on April 15 when officers responded to reports of retail fraud at Marco’s Pizza and the alleged stabbing of Mielock in a parking lot near Abbot and Lake Lansing Roads.

At the scene, Kirby ran towards police, who said he did not follow orders to drop the knife in his hand.

In 2022, an East Lansing officer-involved shooting involving 23-year-old DeAnthony VanAtten resulted in a referral to the Michigan Attorney General's Office. No charges were ultimately filed.
