—The Michigan Court of Claims has declared the state’s 1931 ban on abortions to be unconstitutional in a decision Wednesday afternoon.
The law, which banned abortions except for in rare instances where the health of the mother was at immediate risk, was struck down in the case of Planned Parenthood of MI v. MI Attorney General, House of Representatives and Senate.
The decision comes after weeks of litigation surrounding the law and its enforcement by district attorneys. The Court of Claims had issued a temporary injunction on the law following the US Supreme Court’s overruling of Roe v. Wade.
Judge Elizabeth Gleicher handed down the decision, which permanently prohibits the state attorney general from enforcing the law.
