A former MSU student had recently filed charges against an East Lansing police officer for arresting him for using $50 bill that was not counterfeit.
Former MSU student Julian Yaldo is pursuing a lawsuit filed in March of last year against East Lansing police officer David DeKorte, alleging false arrest and malicious prosecution.
On July 24, 2011, Yaldo visited Dublin Square Irish Pub & Restaurant and attempted to pay using a $50 bill. The bill was wrongly thought to be counterfeit by the then general manager, who refused to return the bill and called the police.
Officer David DeKorte arrived on scene and arrested Yaldo.
According to court documents, DeKorte said Yaldo was “yelling and screaming at employees and was basically out of control,” and arrested him for loud and boisterous disorderly conduct.
However, Yaldo said he was arrested for attempting to use counterfeit currency and when the bill was found not to be counterfeit, the arresting officer alleged the arrest was made because of disorderly conduct, according to court documents. Yaldo was never actually charged with attempting to use counterfeit currency.
The charges for disorderly conduct were later dropped in exchange for Yaldo accepting responsibility for an unrelated civil infraction.
Two years later, Yaldo filed a lawsuit against DeKorte, Dublin Square and the employees involved in the incident. The claims against Dublin and its employees have been dismissed, according to court documents.
DeKorte was recently denied a motion to drop the case by Magistrate Judge Ellen Carmody.
DeKorte’s attorney, Thomas Yeadon, preferred not to comment while the case was in litigation.
