Judge dismisses Brenda Tracy's lawsuit against Mel Tucker

Tracy's attorney says she will 'likely' file an appeal

An Ingham County judge dismissed Brenda Tracy's lawsuit against former Michigan State University head football coach Mel Tucker.

At a hearing in Lansing Wednesday afternoon, Judge Wanda Stokes dismissed the nine-count lawsuit, finding that Tracy's claims weren't applicable due to the statutes of limitation or that there were no factual issues for a potential jury to consider, the Lansing State Journal reported Wednesday.

"Justice delayed is often justice denied, but it doesn't mean you can't get vindicated," one of Tucker's attorney, Andrew Abood, told The State News Wednesday evening.

Tracy, a rape survivor and advocate who was sexually harassed by Tucker, filed the suit in October 2024. She claimed that Tucker had attempted to ruin her reputation by claiming that she was extorting Tucker and MSU for money, and claiming that their relationship had been consensual.

Tracy's attorney, Karen Truszkowski, wrote in an email to The State News that she "will likely appeal" the ruling.

Tracy was first contracted by the MSU Football team in 2021, where she was hired to educate the team on sexual assault and consent through her non-profit, Set The Expectation. In September 2023, a USA Today report revealed that Tucker was the subject of a sexual harassment investigation surrounding his masturbating on a phone call with Tracy without her consent in April 2022.

That investigation ultimately found that Tucker sexually harassed Tracy, and the university fired him for cause on Sept. 27, 2023. Tucker sued the university in federal court in July 2024, claiming that MSU fired him unjustly and owes him $80 million in unpaid salary.

This is the second lawsuit filed by Tracy that Stokes has dismissed. She threw out a similar 2023 lawsuit against Tucker — a decision which Tracy appealed.

Tracy is also suing MSU and the board of trustees in federal court, alleging that trustees leaked her name to the media.
