According to Michigan Criminal Attorney, a simple assault isn't strictly defined by physical contact, as an individual can be considered an assault victim through non-physical contact as well.

The suspect, who is not affiliated with MSU, was identified upon meeting with the victim. An arrest was not made in this case, as the offense was a misdemeanor. However, after being interviewed, the suspect has been issued a trespass letter banning them from campus. In the event that the suspect is found on campus again, they will be arrested.

Following normal procedure, MSUPD has submitted the report to the Ingham County Prosecutors Office requesting that a charge of assault be issued against the suspect. That warrant is currently pending. 

“The victim was provided with resources and we continue to support the victim in this case,” Rozman said.

Michigan State University offers many resources for students who experience or witness sexual harassment and other forms of criminal misconduct. MSU Human Resources have provided information detailing how to stay safe and formally report incidents.

For students out and about campus during late night hours, there are services available that can help maximize safety. The MSU CATA buses can transport students across campus until 2 a.m. – as well, The Night Owl buses, which run from 2 a.m. to 9 a.m. The ASMSU SafeRide program is also an option and has been proven to reduce assault-related dangers. Additionally, MSU's sexual assault program is an organization dedicated to helping all those impacted by sexual violence. The program has counseling, support groups and a 24-hour hotline available for students.

The Office of the University Ombudsperson is also a resource that offers confidential counseling to students about any concerns or issues they may have regarding academics, workplace environments or health and safety. To report emergencies, call 911. For non-emergencies, crimes, or suspicious activity, call MSU Police and Public Safety at 517-355-2221. Anonymous texts can be sent with the word “MSUPD” along with a tip to CRIMES (274637). Non-emergencies may also be reported to MSU’s Behavioral Threat Assessment Team by completing the online referral form. Anonymous reports for non-emergencies can be made by submitting a form, calling the anonymous hotline 800-763-0764, or visiting the Misconduct Hotline website.

If a student has displayed behavior that violates the university’s code of conduct, the Office of Student Support & Accountability accepts reports and can also be reached for immediate assistance at 517-884-0789. MSU has a non-retaliation policy that prohibits punishment against individuals who report forms of misconduct, including sexual assault, relationship violence, stalking, discrimination and harassment.
