MSU files for no legal fault for Nassar's decades of sexual abuse

A new school year with a new president has been marked by a motion filed by Michigan State University to dismiss lawsuits from over 100 survivors of Larry Nassar’s abuse.

The university cited in about 1000 pages that they have no legal responsibility to the women, according to The Detroit Free Press.

"Although Nassar’s actions were repugnant and merit the heavy criminal penalties imposed upon him, the law does not support Plaintiffs’ attempts to hold the MSU Defendants liable for his wrongs," MSU’s court filing said according to the Free Press.

Ex-MSU doctor and famed USA Gymnastics doctor was sentenced 40 to 175 years in prison by Ingham County Court and 40 to 125 years from Eaton County Court for decades of sexual abuse. He also has a 60 year sentence for child pornography.

The arguments by MSU’s lawyers:

  • MSU holds no responsibility to what happened to victims off campus, at Twistars Gymnastics Club or within USAG.
  • Individuals reported to the wrong people.
  • Individuals have not said MSU increased danger and therefore the allegations are of a state-created danger.
  • MSU did not know of the widespread pattern of constitutional violations by Nassar so any inaction or action has no grounding in knowledge of sexual abuse.

This court filing follows incumbent University President Samuel L. Stanley Jr. telling media over the length of the summer that he wants to listen to survivors and restore trust in MSU’s administration.

Stanley’s predecessor to the presidency John Engler was publicly shamed for the duration of his time at MSU for disrespecting survivors and stunting the Michigan Attorney General’s investigation into MSU’s handling of Nassar’s abuse at every turn.
