Michigan ban on same-sex partner benefits blocked

In a week full of victories for the lesbian, gay, bisexual and transgender, or LGBT community, Friday saw another big win as a federal judge blocked Michigan’s ban on domestic benefits for same-sex couples.

The ban, which was signed by Governor Rick Snyder in 2011, was a clear violation of the Equal Protection clause of the U.S. Constitution according to U.S. District Judge David Lawson.

The law previously prevented some same-sex couples from receiving benefits if they were employed in certain public industry jobs.

“Today’s ruling is just the first step in a battle that will ultimately be won by common sense, preserving the right of every Michigander to equal protection under the law,” said Jessica Tramontana, communications director with Progress Michigan. “Rick Snyder owes an apology to the thousands of state employees and their families who were targeted by this hateful ban enacted by radical right-wing politicians.

“No one should face state-sponsored discrimination because of who they love.”

This decision comes in the wake of the Supreme Court’s decision to strike down the Defense of Marriage Act on Wednesday, which Judge Lawson cited in his 51 page opinion. The Supreme Court also struck down Proposition 8, enabling same-sex couples in California from wedding once again.
