Judge upholds Proposal 2

A federal judge has upheld the constitutionality of Proposal 2, dismissing a lawsuit Tuesday that challenged the measure passed by Michigan voters in 2006.

The University of Michigan and the American Civil Liberties Union of Michigan were among the plaintiffs in the case, which was filed in December 2006. The case challenged the effects of Proposal 2, which banned the use of affirmative action in public institutions throughout Michigan.

The proposal defined affirmative action as giving preferential treatment to groups or individuals based on race, gender, color, ethnicity or national origin.

ACLU spokeswoman Rana Elmir said the legal team is still reviewing their appeal options.

Michigan Attorney General Mike Cox said in a statement that the ruling “has upheld the will of the people.”
