Proposal not to appear on Nov. ballot

September 9, 2008

The Michigan Supreme Court voted Monday to uphold a Court of Appeals decision to keep the Reform Michigan Government Now proposal off the November ballot.

Six of the court’s seven justices agreed with the Aug. 20 Court of Appeals decision that the proposal, which seeks to rewrite 36 sections of the state constitution, is too lengthy for a single ballot item.

Dianne Byrum, spokeswoman for Reform Michigan Government Now, said the group could take the case to federal court.

When the group took the case to the Court of Appeals and to the Supreme Court, it asked that justices whose terms would be trimmed if the proposal passed be excluded from the hearing. The request was denied.

“We were denied our right to due process,” Byrum said. “We have not ruled out our options, and that would entail federal court.”
