Floormates testify in rape case

For 19-year-old marketing freshman Travis Eichten, the second day in court on Tuesday brought testimony from witnesses and cross-examination of the accuser.

Eichten is accused of raping an Emmons Hall floormate and is facing 15 years in prison.

About eight people took the stand Tuesday including friends, an Olin Health Center nurse, an MSU police officer and a detective.

The woman, a 19-year-old general business administration and pre-law freshman, also was cross-examined for about an hour and 15 minutes Tuesday.

The trial addresses a Sept. 2 incident in which, the student told the jury, after smoking pot and drinking at a fraternity party, she blacked out. She said she woke up mid-fall from Eichten's loft and discovered her underwear across the room.

It was the first of 13 reported sexual assaults beginning in MSU's fall semester.

Defense attorney Frank Reynolds reviewed details of her earlier testimony such as the events leading up to and after that night, including a party she went to with Eichten on Sept. 3.

At points, the student became teary-eyed and answered in mostly one-word "yes" or "no" statements.

MSU students who lived on the floor were among the first to take the stand after the accuser. They testified to details of the night and the following days.

Witnesses said they also had consumed alcohol the night of the incident and did not remember every detail. Accounts slightly varied from person to person.

They told similar accounts of the night when the student, Eichten and friends went to a fraternity party. A group of five walked back to Emmons Hall, and witnesses said Eichten and the student were walking a few feet behind the others. It was then witnesses said they lost track of the pair.

Some witnesses told the jury that about 20 minutes later, Eichten reappeared in a friend's room, dressed in a towel and said, "Mission accomplished." This concerned some of them, they said.

Eichten's roommate testified he then went back to his room and saw the student in Eichten's bed. He said he called her name three times, but she didn't wake up.

The next morning, "the floor was abuzz" about the events of the night before, said Ingham County Assistant Prosecutor Anthony Flores.

Some witnesses said when they talked to Eichten the next day, he expressed concern that the student did not remember they had sex.

Two of the students' floormates said Eichten came to their room, and asked him about the incident. He first refused to talk, then closed the door and told them his concerns. The two women told the jury that they advised him to speak with the student.

The student told the jury Eichten did talk to her, telling her they had sex and that he had used a condom. He then apologized and said he thought she was aware of what was going on.

The roommate and a friend said they talked to her after the incident, and she "had tears in eyes; she was visibly shaking and was upset."

The woman went to Olin on Sept. 8, complaining of shoulder pains, and the nurse said she noticed bruising on the woman's inner thigh. Further details about the weekend were revealed, and the woman alerted the police.

Pictures taken by MSU Detective Ann Stahl were shown to the jury and documented the student's bruises.

The prosecution closed with the detective's testimony, and Circuit Court Judge Joyce Draganchuk ended for the day at 12:45 p.m.

Eichten's trial will continue Thursday from 8:30 a.m. to 1:30 p.m.
