Circuit Court judge rules Jan. 15 primary date unconstitutional

Michigan’s new presidential primary date of Jan. 15 is on hold after an Ingham County Circuit Court judge found the legislation to be unconstitutional.

Judge William Collette ruled today the law prevents public access to information related to the primary. Public record of how people voted would not be kept, but the state’s political parties would have access to it, according to The Associated Press.

The Legislature could go back and change the law before the primary is held.

“We haven’t seen the decision,” said Megan Brown, spokeswoman for Gov. Jennifer Granholm. “We need an opportunity to review it and consider our options to ensure Michigan remains a relevant state in the presidential primary.”

Michigan violated both Democratic National Committee and Republican National Committee rules when legislators voted to move the state’s presidential primary to Jan. 15.
